Wanted by Switzerland and arrested in Spain
Switzerland is not in the EU, so there is no European Arrest Warrant: its requests follow the European Convention on Extradition of 1957. They are usually well documented, often for fraud, forgery and property offences, and the court rarely refuses them. The value of the defence lies in the details: custody, conditions and what the person is actually surrendered for.

Decisions on the merits of the National Court on requests from this country that I have reviewed (2025–2026, 14 decisions). One case can produce more than one decision. Conditions, such as returning to Spain to serve the sentence or guarantees on prison conditions, are usually obtained by the defence.
What the court checks, and what it does not
In extradition the National Court does not decide whether the person is guilty. It checks that the facts are a crime in both countries, that they are not time-barred, that the penalty reaches the minimum and that the request describes the facts clearly. Arguments about the evidence belong in the Swiss proceedings, with a Swiss lawyer.

How we will understand each other
I work in Spanish. With my clients from abroad I use translation tools to read and answer messages, and we manage well that way. At the police station and in court the law gives you a free interpreter, and I make sure that right is respected. If you write to me in English, I will answer you.

Should I consent to go to Switzerland?
Consent speeds things up and many people choose it, but it should be decided after reading the request: what offences it covers, whether any is time-barred and what custody conditions you can obtain.
Can I be released while the extradition is decided?
It depends on the risk of flight and your ties to Spain. A stable address, work and family here are the arguments that work.
